Learning objectives
1. Knowledge and understanding
· Understand the regulatory and theoretical framework of mediation (domestic and international law, conflict theory).
· Become familiar with the role of the mediator, the parties, and the lawyers in the negotiation process.
2. Applied knowledge and understanding
· Be able to distinguish between competitive and collaborative approaches to conflict resolution.
· Apply negotiation techniques, active listening, rephrasing, and emotion management during simulated mediation sessions.
3. Independent judgment
· Develop the ability to independently assess the relational and communicative dynamics of conflict.
· Recognize the limitations and opportunities of a mediation process compared to other legal instruments.
4. Communication skills
· Communicate effectively in a non-adversarial context, using clear, respectful, and cooperation-oriented language.
· Manage complex interpersonal relationships in an empathetic, constructive, and professional manner, even in intercultural contexts.
5. Learning skills
· Reflect critically on one's own communication and relational performance, with the ability to self-evaluate and improve.
· Develop experiential, collaborative, and interdisciplinary learning through simulation and discussion with experts.
Expected learning outcomes
Upon completion of a mediation or negotiation moot, students should be able to:
· Understand the legal and theoretical framework of mediation and consensual resolution methods (1).
· Simulate a negotiation or mediation session by consciously assuming the role of the party or mediator, applying appropriate strategies (2).
· Critically evaluate communication and conflict management processes, including from an ethical and deontological perspective (3).
· Demonstrate advanced communication skills in a cooperative context, including empathic listening, rephrasing, and managing body language and tone (4).
· Work effectively in teams and learn through feedback, role playing, and individual reflection (5).

Theoretical foundations of communication, negotiation and mediation; introductory, exploratory, negotiating and concluding phase of mediation; mediation exercises and simulations; participation in national and international competitions.
Teaching methods
Lectures on the theory of mediation and negotiation.
Simulations of cases, debriefing and discussion.
Teaching Resources
Past cases from the Paris International Chamber of Commerce Moot Mediation competition, the Vienna Consensual Dispute Resolution Competition, and the Milan Competizione Italiana di Mediazione.
Assessment methods and Criteria
The final positive evaluation and the attribution of 3 ECTS credits occur in the event of active participation in national and international mediation and negotiation meetings to which the University of Milan's Team will be admitted.
