The content of the Course comprises the following topics:
Course Introduction;
The shift towards the contractual nature of public sector employment;
The Sources of public sector employment;
Collective Bargaining in the public sector;
Trade Union rights in the public sector;
The access to public sector employment;
Job description and incompatibilities;
The rules in matter of "Mobilità collettiva", "Mobilità individuale" and employee relocation;
Flexible contracts;
Remote working In the public sector;
The cases of suspension of the employment contract;
Working time regulation;
Economic conditions and performance;
Health and safety measures;
The disciplinary power;
Dismissal regulation;
Public sector management;
Prerequisites for admission
There are no prerequisites. It is mandatory that the enrolled student had previously passed the exam of "Diritto pubblico" in order to validly be tested at the end of the course.
Teaching methods
The instructs will be giving class with the use of slides, which will be made available to the enrolled students on MyAriel. The slides are mandatory teaching material.
Teaching Resources
The reference book for attending and non-attending students is the following: F. Carinci - A. Boscati - S. Mainardi, Diritto del Lavoro nelle Pubbliche Amministrazioni, Torino, Utet, 2021 (2024).
As an alternative text, the students may consult the following book: L. Fiorillo, Il diritto del lavoro nel pubblico impiego, Padova, Piccin, 2019 (2024).
The Instructs will upload the slides (which are mandatory teaching material) on MyAriel.
Assessment methods and Criteria
Attending and non-attending students will be subject to an oral exam, where the instructors will assess the comprehention of the legal institutions of public sector employment and the sound use of the specific language by the candidates.
The attending students will have the chance to give a written text which takes place at the end the course and involves the study of the whole course program.
